Non bailable warrants issued against Comm Secy Education
DGP directed to get warrants executed

Srinagar, Dec 23: The High Court (HC) has issued contempt proceedings (Robkar) against Commissioner Secretary Education Shaleen Kabra and asked the Director General Police (DGP) to get the warrants executed after the former failed to implement directions issued by the court earlier.
Justice Muzaffar Hussain Attar of the High Court after hearing the arguments in the Contempt Petition filed by one Zahida Parveen Vs State of J&K and others observed that neither the compliance report nor the reply to show cause notice has been filed by the respondents.
"Even the Commissioner Secretary Education is not present as directed by the Court on 23rd November, 2016. The Registry shall issue bailable warrants to the amount of Rs 50,000 to secure the presence of the Commissioner. It shall be the duty of the Director General Police to get the warrants executed," the Court directed.
The copy of the high court directions which is in possession of Early Times also reads: "The respondent shall also explain as to why he shall not be punished for willful and deliberate dis-obedience of the Court order,"
The Court observed that in ordinary manner its orders were not being implemented by the concerned authorities unless the rule is framed. "In this case despite the fact that judgment has attained finality, same is not being implemented," it added.
The contempt petition had been filed by the private respondent against the contemnors for willfully disobeying and intentionally not implementing the earlier judgment dated: 5.10.2015 in SWP No: 2412/2015 titled "Zahida Parveen Vs State and Others.
The petitioners have also sought direction against the contemnors directing them to implement the judgment dated, 05. 10.2015 passed by this court in the above titled writ petition in full letter and spirit and consequently to act upon the same without any further delay.
"By virtue of various notifications bearing Nos. 03 of 2012 dated 28.12.2012, 05 of 2013 dated 02.03.2013 and 06 of 2013 dated 10.05.2013, post of teachers were thrown to advertisement for a selection process to be undertaken by the respondent Board, both in open Merit as also reserved categories in District Cadre Baramullah. That the petitioners being well qualified having qualification Gradation, B.Ed and M.ED, Graduation, PG and graduation, B.Ed and PG respectively sought consideration against the posts.
The court had directed the state respondents to issue engagement orders in respect of the petitioner as well as the private respondents. The private respondent was represented by Advocate Mir Suhail.
