Nominate chairman to fee fixation committee for private schools: HC to govt

Jammu, June 2: The state High Court has asked government to nominate a former judge as chairman of a committee for fixation of fee structure of the private schools in the state.
"The committee constituted pursuant to government order no. 520-Edu of 2013 dated 07-05-2013 being non-functional due to resignation of the chairman, the state government is directed to nominate a retired judge of this court as chairman, if not already nominated, within one week, for fixation of fee structure of the private schools," the division bench of Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur said while disposing of two Public Interest Litigations.
However, the court made it clear that if any school management was not satisfied with the fees to be fixed by the committee, it was open for them to approach the court for redressing their grievances.
The direction followed submissions by advocate general R A Jan that the government was considering the nomination of a retired judge as panel's chairman within a short span of time.
Jan said the other members of the committee being ex-officio members, there may not be any impediment in its functioning.
He also stated that individual school managements can approach the fee committee for getting clearance regarding collection of tuition fee, bus fare, etc.
The committee became non-functional as its chairman Justice Bilal Nazki, a former Chief Justice of Orissa High Court, had relinquished the post.
In another direction, the court granted liberty to the managements of the un-aided private schools to approach the committee for fixation of fee structure of each standard.
"Till new fee structure is fixed by the committee, the managements shall collect all type of fees as in August 2014," the division bench added.
About the plea seeking direction to the government to assess the losses to the schools caused by the floods, the court said, "Such general prayer is not maintainable."
"The issue will come within the ambit of flood relief package already announced by the government. If any of management has not been provided with the flood relief for rebuilding of the school buildings, library etc, liberty is granted to such school managements to approach the concerned authority of the government seeking flood relief," the court said.
If any such request is made, the court directed the authorities that same shall be considered with all seriousness and appropriate amount be sanctioned as per guidelines already finalized by the government.
