SIC puts Director Rural Dev Jammu on penalty notice

Srinagar, Aug 10: The Director Rural Development Department (RDD) Jammu has been slapped with a penalty show cause notice by the State Information Commission (SIC) or failure to dispose of a RTI plea while he was designated Public Information Officer (PIO) in the office of Transport Commissioner during his earlier posting.
Details available with Early Times reveal that one Jagdev Singh a resident of Janipur Jammu had filed an RTI application before the PIO, Office of the Transport Commissioner, J&K on 02.03.2015 seeking certain information. PIO passed an order on 17.3.2015 advising the information seeker to deposit an amount of Rs.1040/- as copying charges as provided under RTI Rules of 2012.
Accordingly, the information seeker deposited an amount of Rs.1040/- on 23.3.2015 in the shape of a Bank Draft drawn in favour of Transport Commissioner, J&K. PIO was under legal obligation to provide the required information to the information seeker within 30 days . As the information seeker did not receive any information from the PIO, he filed a complaint before the State Information Commission (SIC) on 27.4.2015.
Accordingly, hearing was fixed on 03.08.2015. Vikas Sharma, Deputy Transport Commissioner-cum-PIO attended the hearing before Chief Information Commissioner (CIC) G R Sufi. The complainant informed the Commission that after the matter was taken up with the Commission and notices were issued to the PIO, the information was received by him on 11.7.2015 through speed post.
Present PIO was heard during August 3 hearing. He informed the Commission that the ex-PIO M.L. Raina (presently Director RDD Jammu) had prepared the information sought by the information seeker and was only to be dispatched to the complainant. But the same was not dispatched by the office of the Transport Commissioner.
SIC 's decision reads as:
"Commission has gone through the record and also heard the present PIO Vikas Sharma. the Ex-PIO M.L Raina, presently Director Rural Development Department, Jammu is directed to explain why penalty may not be imposed on him as provided under Section 17 of the J&K State RTI Act, 2009. His reply, if any, must reach this Commission within 30 days from the receipt of this order. Present PIO Vikas Sharma is directed to serve a copy of this order to M.L. Raina ex-PIO".
