Not averse to investigation by other agency : Police | JKCA scam | | Early Times Report
Srinagar, Aug 10: Police today said that it was not averse if the investigation into the alleged Rs 113 crore scam in J&K Cricket Association was handed over to some other agency. "We are not averse to if the investigation is handed over to any other agency. We have no objections," said Additional Advocate General Asif Ahmad Bhat before a division bench headed by the court comprising Chief Justice N Paul Vasanthakumar and Justice B L Bhat during the hearing of Public Interest Litigation filed by two former cricketers. "We admit that the investigation moved at snail's pace but there are reasons and one of the main being the damage caused by last year's floods to the records," he said and added that the police needs experts to verify the financial statement. "We have already taken up the matter regarding the services of financial expert with the government through PHQ. We are from executive wing while other agency like crime branch has own experts. Besides, we are involved in maintaining law and order problems," he said. Advocate Mian Qayoom, representing the petitioners, said that the PIL has not been filed against any person. "We want the money, which belong to people and has been embezzled should be recovered. Despite there being an in-house panel report, no action has been taken and this is the reason we are before the court," he said in his arguments. Senior advocate R A Jan, representing Mohammad Ahsan Mirza, former treasurer of JKCA and the alleged main accused in the case, said that he was ready to face any probe and has already volunteered himself. "While everyone is after his blood, he wants to truth to be out. Let there be any time-bound investigation and if found guilty, he should be given any punishment," Jan said. About Mirza's custodial interrogation as sought by the police, Jan said that the Supreme Court has made Advocate N A Ronga, representing another prime accused, Mohammad Saleem Khan , ex-general secretary JKCA, also volunteered to work together with the investigation agency while emphasizing that there should be fair and time bound probe. "Those found guilty should be punished. Whosoever be the investigation agency, the probe should be made time-bound." advocate Javed Iqbal, representing former chief minister and "president JKCA" Farooq Abadullah also called for time-bound probe into the scam.the court said that it will pass orders in the case later. "The enquiry should be with a time frame and should be concluded with all fairness," Iqbal said. On March 10, 2012 police had registered a case (FIR 27/2012) following a complaint from then chairman JKCA, Mohammad Aslam Goni through a fax mentioning that as per the report of then treasurer, Manzoor Ahmad Wazir, bogus accounts on JKCA funds have been operated in the various J&K Bank accounts by the ex-General Secretary and then Treasurer under their joint signatures. Goni had also alleged misappropriation of funds. Initially the investigation of the case was carried by SHO of police station Ram Munishibagh but later District Police Headquarters Srinagar constituted a Special Investigation Team (SIT) headed by then SDPO Nehru Park for the purpose. During the course of the investigation, the police has said, JKCA official records were seized from its Headquarters at Sonwar as well as residential places of alleged accused. "The bank records relating to JKCA accounts were obtained and the statements of witnesses were recorded. During the course of investigation details relating to CCRs/FDRs prepared in the various bank branches were also obtained/seized which were operated by JKCA functionaries from time to time." In the meantime, police said, necessary correspondence was made with Administrative Officer BCCI Mumbai wherefrom the details of payments made by JKCA was obtained from the financial year 2002-03 up to December 31 2011 aggregating to Rs 113.67 crores through cheque from time to time and subsequently the bank accounts of JKCA central body were freezed. |
