Infamous CET Scam: DB rejects bail plea of approver | | | Early Times Report Srinagar, Aug 13: The Division Bench of J&K High Court comprising Chief Justice N Paul Vasanthakumar and Justice Hasnain Mossodi today rejected bail application of an approver in multi-million Common Entrance Test (CET) which was allegedly engineered by former chairman of Board of Professional Entrance Examination Mushtqa Ahmad Peer. While dismissing the bail to the approver, Farooq Ahmad Itoo, the Division Bench observed that it is only after the entire evidence is brought on record that trial court may be in a position to see whether person accepting tender of pardon has adhered to assurance given by him. "We have to realise that approver was think with accused or co-conspirators before he volunteered to turn approver, court said and added that his decision to help criminal justice machinery to punish guilty may be appreciated by society but is bound to be resented by his friends with whom formed conspiracy. They are bound to take him traitor and nurse rancour and bitterness against him and there is harm that he may be put to harm in the event he is let off on bail," the division bench said and rejected his bail. Farooq Itoo has been granted pardon after he voluntarily chose to be an approver in the case, described by trial court to be a "great societal and public importance". Itoo is in jail for more than year and half. He had sought bail, contending that he has been honest in disclosing information touching the alleged scam and withstood cross examination. |
