ETT scam: DB for custodial interrogation of accused, entrust more men

Srinagar, Aug 13: Decrying delay in investigation, a Division Bench of the State High Court comprising Justice M H Attar and Justice A M Magrey today directed Inspector General of Police (IGP) Crime Branch to entrust the investigation related to ETT college scam to more than one officer to conclude it at the earliest. Court also observed that custodial interrogation of the accused persons will further help the probe to case speedily.
Hearing a Public Interest Litigation (PIL) Parents Coordination Committee V/s state, the Division Bench favoured custodial interrogation of the accused.
When the hearing was taken up today, the Division Bench of the High Court said It appears that huge number of ETT institutes are involved in the commission of crime.
"Entrusting of investigation to one investigation officer may not serve the public interest," it said further expressing hope that the IGP will workout mechanism to hand over the investigation to more than one police officer.
Taking strong notice of slow pace of investigation, court said, "At the moment, in the manner the investigation is going on, it will definitely take years together for its completion. "Delay in investigation of a criminal case, in itself defeats the purpose sought to be achieved by punishing the persons, who commit crimes," the division bench said, and directed investigation agency to bring culprit to justice at the earliest.
"All those persons, who till date have been prima facie found to be involved in commission of crimes, it appears have not been arrested. Custodial interrogation of the accused persons will further help the investigating agency to unearth the truth at the earliest and arrests shall not be made by adopting pick and choose method," said the division bench.
Meanwhile, the Division Bench also directed the government to issue an order for constitution of Committee which according the Commissioner Secretary Education Department would be constituted for harmonising various rules pertaining to the functioning of the ETT colleges.
"As already directed, one of the members of the Committee shall have to be a law knowing person/legal expert and the Committee shall convene fortnightly meetings and submit its report to the registry (of court) about the decisions taken," the Division Bench added.
