| Tehsildar ignores SIC orders, denies info | | Encroachment of Pond in Samba village | | Early Times Report
jammu, Aug 17: The district administration Samba particularly the concerned Tehsildar has denied information under Right to Information Act (RTI) to an information seeker vis a vis a public property (Pond) which has been encroached by some people at village Gudwal. The State Information Commission (SIC) had directed the district administration Samba to provide the information but the Tehsildar concerned never implemented the said orders.
The State Information Commission (SIC) vide its order No.SIC/J/A/216/2014/292 dated 03.12.2014 had directed the PIO/Assistant Commissioner(R), Samba to provide the requisite information free of cost to the appellant within two weeks from the date of receipt of this order under an intimation to the Commission.
The Complainant, Ruder Chand a resident of Gudwal district Samba filed a complaint dated 06.01.2015 for non-compliance of the aforesaid order of the State Information Commission (SIC).
The Commission after receiving the complaint for non-compliance, listed the matter for hearing and PIO/A.C.(R), Samba vide office No.DCS/HQA/15-16/06 dated 02.04.2015 intimated the Commission that the applicant in his RTI application sought information regarding the submission of report from Avtar Singh Jastrotia (Tehsildar, Jammu) in the light of the letter No.DCS/SQ/14-15/130-32 dated 28.04.2014. The PIO/A.C.(R), Samba further submitted that with regard to the aforesaid letter, the Additional Deputy Commissioner, Samba directed Avtar Singh Jasrotia to furnish reply regarding allegations leveled by Ruder Chand against the then Tehsildar, Samba that he had not taken action against the encroachers of the pond situated at Gudwal and on the contrary provided assistance to the encroachers.
Thereafter as per details available with Early Times the Additional Deputy Commissioner, Samba issued reminder to Avtar Singh Jasrotia (Tesildar) vide No.DCS/Addl.Deputy Commissioner/14-15/603 dated 11.03.2015 but reply of the Tehsildar is still awaited. However, the PIO/A.C.(R), Samba denied the receipt of first appeal, filed by the appellant in his office and submitted that there is no trace of his first appeal in the Receipt/Dispatch Register in his office.
"From the aforesaid reply filed by the PIO/ A.C.(R), Samba, it is evident that Sh.Avtar Singh Jasrotia, then Tehsildar, Samba has not submitted any report/reply sought by the information seeker in his RTI application filed before the PIO/A.C(R), Samba. The PIO/Asstt.Commissioner(R), Samba, Sh.Sonu Pargal is hereby directed to furnish the detailed response to the complainant in the light of the counterstatement bearing No.DCS/HQA/15-16/06 dated 02.04.2015 within one week from the date of receipt of this order under an intimation to the Commission" reads the SIC order. |
