ACR Central violates court order, denies promotion to 'seasoned' Patwaris

KUPWARA, Dec 21: Despite the court directions, 10 out of 33 Patwaris of 1991 batch of this North Kashmir district have been pushed to the wall since the department of Revenue has withheld their promotion orders as Girdawars (Qanoongos).
Sources told Early Times that Divisional Commissioner Kashmir cleared promotion of 33 Patwaris of Kupwara district as Girdawaras (Qanoongo's) in the Departmental Promotion Committee (DPC) which was held in October 2015.
Sources said the order could not be implemented as a group of patwaris of 2002 batch challenged the promotions in the High Court at Srinagar. Following the submission of the writ petition the High Court granted relief to the petitioners and ordered for the stay of DPC order.
After stay order, 10 senior Patwaris approached the court and filed a writ petition in which they submitted that stay on their promotion is sheer injustice as they were appointed in 1990 and 1991, said sources.
"The 10 senior Patwaris of 1991 batch who have been hit are Farooq Ahmad Khan, Bashir Ahmad War, Abdul Ahad Lone, Abdul Rashid Malik, Wali Mohammad Lone, Ghulam Rasool Wani, Bashir Ahmad Wani, Ghulam Ahmad Parray, Parvaiz Ahmad Mir and Abdul Hameed Mir," said sources.
The five Patwaris who had gone to the court challenging the promotion of their senior colleagues gave a written affidavit stating that they have challenged the seniority list pertaining to batch of 2002 and not for the batch of the year 1991 and has no objection in case the formal order is considered and issued in favour of senior Patwaris.
Following this the court vacated the stay on their promotions and passed an order to government that service rights of 10 Patwaris appointed before 2002 should not be withheld.
"Applicants are not party to the writ petition, interim directions passed by the court will not affect their service rights before the bench of Hon'ble Justice Muzaffar Hussain Attar," reads the order vide SWP NO: 2275/15 c/w SWP NO.1762/2015 in the High Court of Jammu and Kashmir.
Meanwhile a delegation of the affected Patwaris while talking to Early Times alleged that Assistant Commissioner Revenue (ACR) Central at Divisional Commissioner's Office is not serious in implementation of court directions, which is completely 'contempt of court'.
"Some of the Patwaris of 1991 batch are near to retirement, after which there is no fun of promotions, Despite court directions, the department of Revenue is not issuing formal orders to us," said the Patwaris.
