HC issues directive to NHAI

Jammu, Jan 2: In a petition filed by the owner of a banquet hall, High Court judge Hasnain Masoodi today issued notices to the state, SSP, Jammu, SHO of Gangyal police station, and R P Singh, General Manager (T), Project Director, National Highway Authority of India (NHAI), Jammu, and also directed them to maintain status-quo with respect to the land measuring 1 kanal 10 marlas situated under survey No 250 min at Kunjwani here.
It was submitted before the court that the petitioner is the owner in possession of the land under survey No 250 min measuring 1 kanal 10 marlas at Kunjwani. It was also pleaded that there was a litigation between the parties and the matter was finally adjudicated upon by the high court division bench which, while disposing off the appeal, held that the petitioner would deal with the property in accordance with the law governing the field and it was further provided that while dealing with his immovable property, the respondents shall follow the procedure established by law. The counsels submitted that as R P Singh could not succeed in litigation against the petitioner, he wrote a letter to the SHO of Gangyal police station to register an FIR against him in order to take revenge. The petitioner moved high court and that order was stayed. But all of sudden and to the petitioner's utter surprise, on early morning of December 5, 2015, R P Singh along with tehsildar, Bari Brahmana, came to the spot and demolished the structure already raised by the petitioner on his own land.
The counsels said when the petitioner resisted, they allegedly threatened that he would be killed. And, when he asked them to show that by virtue of which order or notice they had demolished the structure despite of the fact that there were court directions but they did not pay any heed and started abusing him. The petitioner pleaded that this act of respondents was illegal, vindictive and revengeful because of the ongoing litigation between the parties. After hearing his counsels, Justice Masoodi issued notices to SSP, Jammu, SHO of Gangyal police station and others and directed the parties to maintain status quo.
