Center asked to get 8 Assembly seats defreezed for PoK, West Pakistan refugees

Jammu, Jan 2: Rajya Sabha Committee on Home Affairs has asked Prime Minister Narendra Modi-led Central Government to persuade Jammu and Kashmir Government to defreeze 8 seats out of 24 freezed Legislative Assembly seats in favour of refugees of Pakistan occupied Kashmir (PoK).
These 24 seats have been originally designated for territorial constituencies of Jammu and Kashmir that now lie in Pakistan occupied Kashmir (PoK). Refugees of PoK have been demanding defreezing of eight seats out of 24 for them but the same has been repeatedly refused by Jammu and Kashmir as well as the Central Government on the grounds that the present State constitution does not allow making any such move.
Yet the high profile Rajya Sabha Committee on Home Affairs headed by P. Bhattacharya has recommended defreezing of the 8 seats while adding that the same should be done at the earliest so that those displaced by the communal fury of 1947 get which is democratically otherwise meant for them. Committee has said that the PoK refugees must have right to elect and get elected in all representatives bodies to enhance strength of democracy.
Not only PoK refugees, the committee has further said that Union Ministry of Home Affairs should pursue with the State Government to examine the issue of reservation of seats in the Legislative Assembly and Legislative Council of the State for West Pakistan Refugees (WPRs), and if necessary, may move for necessary amendment to J&K Constitution. It has said that these refugees must have right to elect people of their choice from among themselves.
Committee has further noted that various instructions/guidelines issued and requests made to the Union Ministry of Defence to issue such instructions allowing recruitment of West Pakistan Refugees (WPRs) as well as their wards settled in J&K to the Central Para-Military Forces and in the Indian Armed Forces without the condition of having a domicile certificate from the designated authority of the State Government.
Committee has recommended that instead of domicile certificate, Sarpanch/Numberdar certificate accompanied by electoral roll should be accepted as proof of their being west Pakistan Refugees (WPRs). It has asked the Union Home Ministry to monitor or undertake requisite follow-up action in tandem with the State Government to ensure the compliance of its instruction in the matter.
Committee has strongly recommended that the Union Ministry of Defence must actively consider the request made by Union Ministry of Home Affairs vide its letter dated January 7, 2015 and 09-02-2015 in regard to recruitment of the wards of WPRs in the Indian Armed Forces. It has asked the Union Defence Ministry to issue express directions to the recruiting agencies so that the refugees of PoK as well as West Pakistan get all the benefits of reservation and other necessary instructions issued in this regard.
