Jammu, Mar 3: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today set aside the writ court order on selection of a candidate in PG course under ALC category. The court directive came in a LPA filed by J&K Board of Professional Entrance Examinations against the writ court judgment whereby it had directed to select and allocate stream of MD/MS/PG Diploma course by treating petitioner as candidate belonging to ALC category. The bench, after going through the appeal and writ court judgment, observed that in this case, since the 1st respondent had not claimed seat under ALC category for admission in PG course, the order of Single Judge giving direction to treat Sovia Anand as ALC category candidate and consider her for admission against the vacant seat could not be accepted when she was not vigilant while submitting her application as well as in getting renewal of her ALC status, which she could get only after the merit list for admission was published. The bench observed that the question of granting admission beyond the cut off date "does not arise, hence the issue regarding giving direction to admit the candidate in PG course after the cut off date needs no finding". With these observations, the bench allowed the appeal and set aside the writ court judgment. (JNF) |
