Samba ARTO, ex-SHO of Vijaypur PS booked | | | Early Times Report
Jammu, Mar 3: The crime branch (CB) of J&K police, on the basis of a letter of state vigilance organisation (SVO), has registered a case against ARTO, Samba, ex-SHO of Vijaypur police station and others in a case of cheating. The case was registered against Samba ARTO Pawan Sharma, Vijaypur police station's then SHO Ajay Singh, Sohail Ahmed, son of Gulzar Ahmed of Iqbal Chowk, Gujjar Nagar, and Zaffar Ahmed under sections 420, 467, 468 and 471 of RPC read with section 5(2) of P C Act Svt 2006. A report of verification along with a written complaint lodged by Thoru Khan, son of Choda Khan of Gujjar Nagar, against Pawan Sharma, Ajay Singh, and others with SVO was received by CB, Jammu, through AIG (Hqrs) vide January 25, 2016 communication No VO/Veri-Jmu-12/2015-1210-11 for registration of a formal case in the matter. The complainant alleged that in March 2014, Sohail approached him and asked him to buy a fresh Polo car for Rs 7 lakh which he accepted. He purchased the car after paying Rs 3 lakh as advance. He paid him remaining Rs 4 lakh after some time when Sohail gave him original Registration Certificate (RC) of the car issued by ARTO, Samba, along with other documents. However, he later came to know that the car originally belonged to one Zorawar Singh of Gurah Salathia, Samba, who had purchased it on loan secured by him from J&K Grameen Bank Ltd, Gurah Salathia, but there was no mention of the hypothecation on the RC. When he enquired from Sohail, he told him that he had purchased the car from Zaffar Ahmed of Channi Himmat and that he should not worry about the bank loan as NOC from the bank would be obtained by him but till date neither NOC was provided nor any response was made to his phone calls by Sohail. It was alleged that the ARTO, in connivance with his staff and Sohail, had issued the RC without mentioning the hypothecation deliberately in order to have pecuniary benefits. But after some time, Sohail, allegedly in connivance with Zafar Ahmed, Pawan Sharma and Ajay Singh lifted his car from Gujjar Nagar and took it to Vijaypur police station. Ajay Singh, instead of taking a legal action against Sohail and Zaffar, in sheer misuse of his official powers and in furtherance of the criminal conspiracy, kept the vehicle unauthorisedly in his personal possession and used it for about a month and thereafter handed it over to Sohail and Zaffar, thereby causing a huge loss to the complainant. On receipt of this complaint, SVO initiated a verification and came to know that Sohail and Zaffar had sold the car owned by Zorawar to the complainant for Rs 7 lakh and thereafter, in connivance with the officers of ARTO, Samba, managed the transfer of RC and other documents of the car in the name of complainant on the basis of a fake bank NOC without the consent of its original owner Zorawar, who at that time was behind the bars in an NDPS case registered in Punjab. It was also revealed that Ajay Singh, in sheer misuse of his official position and in league with other accused, deputed two cops to lift the car and bring it to the police station without registering any FIR in the matter. He was alleged to have used the car personally for about 20-30 days without displaying its number plate. On repeated requests of the complainant and Zorawar, he didn't return the car to them but handed it over to Zaffar allegedly in lieu of pecuniary benefits, and in this way, all the accused in furtherance of a criminal conspiracy cheated the complainant solely in order to cause wrongful gains to themselves and wrongful loss to the complainant and others.
