The convicts included Mohammad Anwar, Mohammad Aslam, sons of Muneer Hussain, Mohammad Sharief, son of Suba, and Mohammad Zaffar, son of Ghulam Hussain, all residents of Planger in Thanamandi, Rajouri.
In 2007, buffaloes of Nissar Hussain, son of Salah Mohammad of Lal, were stolen from a pasture in Kashmir and the theft allegations were levelled against Mohammad Zaffar who had denied the allegations.
In 2009, Zaffar along with his live stock was intercepted by Nissar and others while he was on way to Kashmir and thrashed. They later took him to Lah along with his live stock.
The matter was, however, settled by the people of Lah and Planger in a panchyat held at Lah but Nissar got a case registered against Zaffar, Mohammad Aslam and Mohammad Sharief.
Irked over his act, the accused conspired to take revenge and on August 7, 2009, they intercepted Nissar near Thub Gali while he was on way to attend a ring ceremony at a relative's house. He was attacked by the accused with sticks, axes and iron rods. He was, however, rescued by his son Altaf Hussain and taken to hospital. Altaf also lodged an FIR at Thanamandi police station against the accused under sections 307, 341, 109 and 34 of RPC.
In the hospital, police recorded the statement of Nissar who later succumbed to his injuries. All the accused were arrested by police and the case was produced in the trial court.
The court held all the accused guilty of murder and accordingly convicted them for the commission of offence under section 302 of RPC read with section 34 of RPC.
The accused were also convicted under section 341 of RPC and were sentenced to undergo imprisonment for life and also directed to pay a fine of Rs 20,000 each. The fine money would be paid to the heirs of the deceased, the court directed.
