Lady SPO denied bail in Khour PS rape case | | | Early Times Report
Jammu June 4: Fast Track Court Presiding Officer Kishore Kumar today rejected the bail application of SPO Mamta Kumari, who had allegedly facilitated a woman's rape by then SHO of Khour police station in police custody last month. The victim had on May 10, 2016 filed a complaint before SDPO, Akhnoor, alleging therein that she had been raped in police custody by then SHO. She said she had on her own eloped with one Vicky Kumar on October 27, 2015 and solemnised marriage with him in Akhnoor court the next day. Thereafter, they went to Katra. The same day, her husband came to know that on the complaint of her father, cops of Pallanwala police post had his father taken into custody. Following this, the duo went to Pallanwala police post on October 29, 2015. The same day, they were shifted to Khour police station. While Vicky was kept in the lockup, a lady cop took her to her quarter and asked her to go to the SHO's room at night, but she did not agree. The next day, she and her husband remained lodged in the police station. Mamta was alleged to have taken her to the SHO's room in the night. She alleged that after she entered his room, he switched off lights and committed rape on her for about two hours. Mamta had threatened her to send her husband to jail in case she disclosed the incident to anyone. On her complaint, a case under sections 376 (2)(a)(iii) and 109 of RPC was registered and investigation was entrusted to IO who, during the course of investigation, established the alleged role of then SHO and Mamta in the incident. The court observed that the victim had categorically supported the role of the petitioner in forcibly sending her to then SHO of Khour PS for committing rape upon her, knowingly that she was not interested in such activities. She had also threatened the victim of not disclosing the act of rape to anybody. In this way, she played a vital role in the commission of offence of rape by then SHO and had been arrested for the commission of offence under sections 376(2)(a)(iii) and 109 of RPC, the court observed. The investigation of the case was at the initial stage and the petitioner 'stands arrested for a very heinous offence and as such does not deserve bail at this stage'.
