Early Times Report Srinagar, June 13: The state high court today disposed of separatist JKLF leader Mohammad Yasin Malik's petition, saying there is no question of his illegal confinement. A single bench of the court comprising Justice Mohammad Yaqoob Mir observed: "The fact of the petitioner having been taken into preventive custody under Section 107/151 Cr. P. C is fully supported by the records as have been produced from the Court of Executive Magistrate 1st Class, South Srinagar." Besides, the court said that three warrants being issued by the Additional District and Sessions Judge, TADA/POTA, Srinagar is also fully supported by copies of warrants annexed in compliance report. In the letter treated as petition, the petitioner had stated that it has become a routine to regularly put him in jail without following due procedure of law. In response, the government said, Yasin Malik was lodged in sub-jail Kothibagh on the orders of executive magistrate 1st class on May 26. The compliance report also showed that three warrants of arrest were issued by the Additional District and Sessions Judge, TADA/POTA, Srinagar, on May23 against Malik. Along with the report, the government produced photocopies of three warrants of arrest issued in connection with case FIR Nos.730/1987, 732/1987 and 654/1987. |
