Early times report Jammu, July 2: 1st Additional Sessions Judge, Jammu, M A Chowdhary today awarded three year rigorous imprisonment to two accused in a fraud case. They included Amar Nath and Tilak Raj. A fine of Rs 10,000 was also imposed on them. A complaint against them was filed by one Surjeet Kour, wife of Bajan Singh of W No 1, Simbal Camp, in the court of Chief Judicial Magistrate, Jammu, who had forwarded it to police in terms of section 156(3) of CrPC, asserting therein that the complainant was owner in possession of 8 kanal 18 marlas of land falling under khasra Nos 191, 192, 193, 203 and 271 at Jajowal, R S Pura. She stated that being an old lady she had executed an irrevocable power of attorney in favour of Amar Nath on August 19, 1996 at R S Pura which was registered with sub-registrar on August 20, 1996, authorising him to deal with the land under khasra No 102 min, measuring 6 kanal 10 marlas at Jajowal. She alleged that taking benefit of her old age, he fabricated a general power of attorney with regard to land falling under khasra Nos 191, 192, 193, 203 and 271, measuring 8 kanal 18 marlas, and gave the her address as Chohala, R S Pura and by presenting a fake lady, the power of attorney was got registered on March 24, 2003. Based on this power of attorney, Amar Nath executed a sale deed in favour of his son Tilak Raj. The general power of attorney was drafted by some advocate and written by one Hans Raj. A case in this connection was registered at R S Pura police station vide FIR No 38/2008 for the commission of offences punishable under sections 420, 467, 468, 471, 120-B and 201 of RPC. After completion of investigation, challan was presented. After hearing the APP, the court convicted the accused for commission of offences punishable under sections 420, 471 and 120-B of RPC and awarded them three years RI, besides fining them Rs 10,000 each.(JNF) |
