Financial crunch jeopardizes setting up of fast track courts | File gathers dust in Finance department | | Akshay Azad Early Times Report JAMMU, Feb 2: Financial crunch has jeopardized the setting up of much awaited 18 fast track courts in Jammu and Kashmir due to which hundreds of cases are pending. The file pertaining to setting up of the fast track courts has been gathering dust in Finance department since long. It's in place to mention here that in view of huge pendency of cases in Jammu and Kashmir High Court and Subordinate courts, the previous government headed by Chief Minister Omar Abdullah had announced to establish 18 fast track courts in last assembly session in March 2014. "A proposal was received by government from the High Court regarding creation of eight Fast Track Courts of the rank of District and Sessions Judge and 10 Fast Track Courts of the rank of Civil Judge Senior Division ( Sub Judge)", sources said. They said that the file pertaining to setting up of 18 fast track courts was forwarded by Law department to Jammu and Kashmir Finance department but the latter has been raising queries, time and again. "Setting up subordinate courts, including fast track courts, is the responsibility of the state governments under the Constitution of India but the state being in financial mess is preventing JK from moving ahead as it would increase the burden on state exchequer," an official in Law department said. He said that though time and again Union government has been asking for setting up of fast track courts but Union government has not sanctioned any funds for it. According to the figures provided by the state government in last assembly session, a total of 2,76,458 cases were reportedly pending in the JK High Court and in other subordinate courts in the State. The pendency figure would definitely have witnessed surge in last more than nine months but so far no headway has been made towards establishing fast track courts, sources said. They said that presently there was no fast track courts in the state except for the five existing regular courts of additional district and sessions which were earmarked as fast track courts by the High Court to deal with the cases against women including rape in Srinagar, Anantnag, Baramulla, Kulgam, Pulwama, Kupwara, Jammu and Rajouri districts. When contacted Law secretary, Mohammad Ashraf Mir said that file is pending with Finance department. "Finance department has been raising queries, which have been replied by this department", he said, adding that financial implications are the main hurdle in setting up of fast track courts in JK. |
