Rajouri, Jan 5: The Programme Officer Integrated Child Development Scheme (ICDS) Rajouri, now transferred, has been served with a penalty notice by the State Information Commission (SIC) as the officer failed to comply with the provisions of State Right to Information Act (RTI). The ICDS officer had not provided information to an RTI applicant who had sought copy of seniority list of Anganwadi workers from Rajouri district. Details available with Early Times reveal that one Rajesh Sharma, a resident of Dalogra district Rajouri filed 2nd appeal under section 16 of the Jammu & Kashmir Right to Information Act, 2009 before the State Information Commission (SIC) on 13.11.2015 stating therein that he had filed an RTI application under J&K RTI Act, 2009 before the PIO-cum-Programme Officer, ICDS , Rajouri on 24.06.2015 seeking copy of seniority list of Anganwadi Workers, who were likely to be promoted as Supervisors in district Rajouri. The SIC went through the RTI application and found that this information was disclose-able and should have even been uploaded on the website of the public authority under section 4 (1) (b) of J&K RTI Act 2009. The Commission directed the PIO-cum-District Programme Officer, ICDS, Rajouri to provide the information to the information seeker within 05 days from the date of receipt of this order. "Rajinder Singh, the then PIO now District Programme Officer, ICDS Kathua is directed to explain why penalty under section 17 of the Jammu & Kashmir Right to Information Act, 2009 may not be imposed on him for failing to give response to the information seeker within the period prescribed under the Act, as well as not complying with the directions of the FAA. His reply, if any, must reach this Commissionwithin 15 days from the date of receipt of this order. With these observations the 2nd appeal is disposed of" reads SIC order dated 23.12.2015 issued by State Chief Information Commissioner (CIC) G R Sufi. |
