Flag issue: What has BJP now to say? | | | Early Times Report jammu, Jan 5: On January 1, Division Bench of State High Court, Jammu Wing, comprising Justice Tashi Rabstan and Justice Bansi Lal Bhat stayed the operation of the judgment of Single Judge (Srinagar Wing) regarding hoisting of State flag on buildings and official vehicles. The stay was granted in a LPA filed by retired IGP and BJP national secretary and his case was represented by another BJP leader, J&K BJP's chief spokesperson. The ruling came as a big relief to the nationalists across India, with the BJP also thumping its chest. The nationalists described the stay as the new year's gift to India. The BJP leadership in Jammu, on the other hand, claimed that it stood vindicated and that it cleared all the doubts in the minds of the people about the nationalistic credentials of the party by challenging the Single Bench's ruling on the State flag. It was expected that the PDP-BJP coalition Government will not make any comment on the stay on the single bench's ruling on the State flag and allow the law to take its own course. It was also expected that the State Government will file its response only before the J&K High Court within the stipulated period of four weeks. After hearing senior advocate in length, the Division Bench had issued notice to Chief Secretary to J&K Government and Abdul Qayoom Khan petitioner returnable within four weeks and called the record of the writ court. It appears that the Division Bench's stay didn't go well with the PDP-BJP coalition Government. How else should one interpret the J&K Advocate General's statement that the recent High Court orders on State flag will have no implications on its status or hoisting. The obligations provided under J&K Constitution vis-a-vis State flag "have to be fulfilled," he also said two days after the Division Bench of J&K High Court stayed the ruling of the Single Bench. To make his point, the Advocate General further said: "The double bench has only stayed the single bench judgment. Whether there is a circular or not, whether there is a judgment or not, the State flag remains there. The State flag has its own status, unmindful of a judgment or a circular". What the Advocate General said was the line of the PDP-BJP coalition Government. It is obvious that the Advocate General spoke on behalf of the PDP and the BJP. What has the BJP now to say? It cannot say anything, as it is a party to the line the Advocate General advocated. Indeed, the BJP, like before, took no time to take another U-turn on an issue of great national importance and it again stands thoroughly exposed in the eyes of nationalists, who have been bemoaning why they voted for the BJP. Indeed, the BJP has embarrassed its own national secretary and J&K BJP's chief spokesperson by not contesting the claim of the Advocate General. |
