Delay in results by SSRB: CIC angry

Jammu, Jan 13: The State Chief Information Commissioner (CIC) has shown his displeasure over the long delays made by State Services Recruitment Board (SSRB) for announcement of the results for different Government posts. CIC while disposing off an appeal filed before the State Information Commission (SIC) observed with shock that the interviews that have been conducted by SSRB number of months earlier have not been finalized with the result that the poor candidates who are aspiring for the jobs have to sit idle for months together and they lose the precious time for joining the government jobs.
Details available with Early Times reveal that one Sonu Sharma , a resident of Dungus district Poonch had filed an RTI application before the PIO, J&K Services Selection Board (SSB) on 08.01.2015 which was received in the office of PIO on 14.01.2015 . The applicant sought photocopies of answer sheet (OMR) and answer key of some exam conducted more than a year back by SSRB . The information seeker sought duly attested copies from PIO SSRB. As the basic fees for obtaining the information was not strictly in accordance with the Rule 6 of the J&K State RTI Rules, 2012, therefore, the PIO informed the appellant to deposit the fees as per the said rule. This intimation was duly received by the appellant as confirmed by him. But instead of removing the relevant deficiency, the appellant directly approached State Information Commission (SIC) vide his application dated: 23.3.2015 for a direction to the Service Selection Board for providing the information. The Commission advised the appellant to file first appeal before the Secretary SSRB who is the First Appellate Authority (FAA) as well. The appellant accordingly filed first appeal before the FAA on 9.6.2015. The first appeal was to be disposed of within the period laid down in section 16 of the J&K State RTI Act, 2009 which has not been done. The FAA i.e; the then Secretary SSRB failed to act as a public authority and did not discharge his functions as assigned to him under the J&K State RTI Act, 2009.
The appellant Sonu Sharma being negligent of the RTI Rules again failed to ensure that the second appeal is supported with all the documentation as per the J&K State RTI Rules, 2012 with the result he had to be again reminded for making up the deficiency. The deficiencies were removed vide his letter on 8.10.2015. The PIO SSRB Javeed Ahmed submitted before the State Information Commission (SIC) during case hearing that part of information was given to information seeker on 2.11.2015. The appellant Sonu Sharma stated that he has not received the said information. A copy of information was provided to the appellant during the hearing by the PIO at SIC office Jammu on December 7th 2015. The PIO SSRB submitted during the hearing that remaining information could not be given because of some court intervention. However, there was no evidence submitted before the Commission to substantiate the PIO's statement. The PIO was directed by State Chief Information Commissioner (CIC) G R Sufi to be careful about making such submissions before the Commission.
The PIO during the case hearing took the plea that interview results were not yet declared though the interview was conducted in September, 2014. Hence information has not crystallized. The information under the J&K RTI Act is to be given which becomes final and crystallized on the date of filing of RTI application.
Order issued by CIC G R Sufi reads as :
"The Commission has observed with shock that the interviews that has been conducted by the Board number of months earlier have not been finalized with the result that the poor candidates who are aspiring for the jobs have to sit idle for months together and they lose the precious time for joining the government jobs. The Commission is informed that normally the final results have to be ensured within 90 days. However, because of one or the other reasons the deadline is not adhered to which results in the considerable delay of offering jobs to the qualified candidates and for no fault of theirs, their tenure in government service is shortened. The Commission would, therefore, suggest the SSB to give a serious thought and consideration to the situation and devise detailed rules with a view to streamline the process of final selection. If the final selection is made after a considerable time it is but natural that it may give rise to various genuine or at times non genuine grievances by the candidates. The Commission has given these suggestions and directions in accordance with the provisions of Section 16 of the J&K RTI Act, 2009. The PIO SSB Javeed Ahmed is directed that remaining information be disclosed to the appellant within a period eight days from the receipt of this order. The Commission would also like to advise the appellant that in case he wants to pursue RTI Act, he should follow the rules laid down in the RTI Rules for filing applications in accordance with the RTI Rules of the RTI Act "
