jammu, Mar 1: Special Mobile Magistrate, Jammu, has directed Crime Branch (CB), Jammu, to investigate the alleged forged cheque case pertaining to M/s Royal Rice Sheller, Akhnoor, and submit compliance report before the next date of hearing on March 31. Brief facts of case are that the complainant had filed petition seeking directions in terms of Section 156 (3) of Cr.P.C to the in charge CB police station, Jammu, for lodging an FIR and investigate the matter. The complainant had approached State Bank of India, Branch Jourian, Akhnoor, in 2007 for availing loan and C C limit facility for his firm M/S Royal Rice Sheller, Mattu, Akhnoor. The loan was sanctioned and C C limit facility was granted. Thereafter in 2009, he entered into a partnership deed after which the firm was virtually taken over by Ramesh Choudhury, son of Tulsi Dass Rio of Mattu. The complainant furnished the deed to then Manager of SBI Bank, Jourian. He submitted that after new partnership deed, he never withdrew any amount from C C limit. SBI filed a suit for recovery which was pending adjudication before the court of 2nd Additional District Judge, Jammu. He submitted that, during his statement as witness before Bishan Lal Lochan, then branch manager, SBI, Jourian, it was deposed that even after change of guarantor and additional mortgage deed, the complainant was the person who had withdrawn the amount from C C limit and signed cheques which was factually incorrect. The complainant also submitted that he neither signed the cheques nor issued them to anybody and alleged that the accused had committed the offence of cheating, impersonation and forgery with the aid and abetment of their other co-conspirators. Left with no other option after approaching to the concerned police, he had approached the court to seek direction for registering the case against the accused. After hearing the two sides, Special Mobile Magistrate Rajesh Kumar Abrol observed that taking into account the facts of the complaint supported by an affidavit, cognizable offences are alleged and it was clear that the complainant had approached this court for directing in charge of CB police station, Jammu, to investigate the matter against the accused under rules and proceed according to law. "Copy of this order shall be sent to SSP and in charge of CB police station under section 156 (3) of Cr.PC to investigate the matter and file compliance report within one month from today and put the case on March 31, 2016. |
