Early Times Report Jammu, Jun 2: Special municipal magistrate, Jammu, M R Chak today rejected the bail application of alleged cheater and rice puller (RP) accused Venkata Krishna Modegula. A complaint against Modegula and other accused was lodged with crime branch (CB) by Rakesh Kumar Gupta of Gandhi Nagar, alleging therein that he had been duped of lakhs of rupees by them in the name of RP. Other accused included D BalasubranayamTirupati, Gowhar Hussain Rather, Afroz Ahmed Khan, Mushtaq Ahmed, Sohail Ahmed Khan, Imtiaz Ahmed Khan, Bilqees Mir, Mohammad Maqbool Dar, Irfan Ul Hamid, Sheikh Irshad, Mohammad Ishtiaq Lone, Syed Gulzar Ahmed, Abdul Rashid Malik. Manoj Kalsi, Balbir Singh, Parvez Ahmed Bakarwal, Tahir Bakerwal, B Ramakrishna, Raju Kumar Singh, Ajay Saini and Ashok Tak. He alleged that the accused approached him from time to time and allured him to buy RP, saying that it would bring him a huge profit. However, after taking money, the accused disappeared. The CB probe proved that Gupta had been cheated. A case was then registered against the accused. Modegula was alleged to have cheated many other persons by using forged documents. He was arrested from Padma Rao Nagar, Hyderabad, on May 6, 2016. The judge, after hearing the two sides, observed in non-bailable and heinous offences, bail could be denied only when there was apprehension of accused misusing the concession of bail by not being available to face the trial. "In the present case, CB has affected recovery of Rs 1 cr from the accused and Rs 2 cr are yet to be recovered from him. He is a non-state subject and in case, he is admitted to bail at this stage, there is every likelihood of his taking to heels to frustrate the recovery of balance amount. From the case diary, it is manifest that besides this amount, huge amount has been transferred by different persons in his account and in all probabilities, the accused, if set free at this stage, shall flee leaving investigating agency in the lurch. Even if investigation is otherwise complete, the accused is not entitled to be released on bail, keeping in view the fact that Rs 2 cr are yet to be recovered from him. He has huge assets and can manage the recovery of balance amount but he cannot ask for bail without affecting the recovery of rest of the amount," the court said. With these observations, the court rejected his bail application. |
