Court denies bail to narcotics smuggler

Jammu, May 16: Principal Sessions Judge Jammu R S Jain rejected the bail application of Mehraj Ahmed Bhat who is facing trial in NDPS Case.
Principal Sessions Judge Jammu R S Jain observed that in the present case, accused was having in their possession of 30 Kgs of poppy straw. The question arises, should the accused be keeping such a large quantity of Poppy straw in their possession cannot be obviously for their personal use but rather to deal in illicit trade of selling the same to the drug addicts. Keeping in view the enactment of the NDPS Act is to curb the ever increasing menace of drug peddling and illegal sale and its ramifications on the society and cause for increase in the crime rate, nature and seriousness of accusation against the applicants and in the larger interest of the society and State, this Court is of the view that no good ground is made out by the petitioner. With these observations Court rejected the bail application.
According to the police case that patrol party of police station Gangyal, jammu stopped truck no.JK013A/3933 being driven by accused on 17/11/2014 On checking the truck two bags were recovered which on opening were found to contain poppy straw weighing 30 kg. As per the report of FSL, the sample taken was identified as poppy straw in which morphene was detected. Accordingly FIR No.160/2014 for offence under sec.8/15 NDPS Act was registered in p/S Gangyal against the accused persons. --(JNF)
