Killing of surrendered militant: CJ directs State to implement direction of SHRC in eight weeks | | | Early Times Report
Jammu, May 16: In a petition filed by Shakeela Akhter whose brother Hameed Makroo- a surrendered militant was killed by some unidentified militants during his visit to maternal aunt at Rakhwochi and his dead body was found on 13/09/1994 on roadside in Gund Khali Naina, the Chief Justice of J&K High Court at Srinagar directed Chief Secretary to implement the order of the State Human Rights Commission within a period of eight weeks from the date of receipt of copy of this order. After hearing Advocate Bilal Ahmad Malla for the petitioner whereas AAG BA Dar appearing for the state observed that complaint before the State Human Rights Commission was filed on 11/03/2009 wherein the State of Jammu & Kashmir was shown as party respondent and the learned Commission after going through the facts and material on 09/03/2012 passed the order. "The said order has not been challenged by the respondents before any forum much less before this court, court observed and said, "Thus finding rendered by the State Human Rights Commission have attained finality and same are bound to be implemented by the respondents and disposed of the petition with the direction to Chief Secretary to implement the order of the State Human Rights Commission within a period of eight weeks from the date of receipt of copy of this order. The petitioner has filed plea to seek direction to Chief Secretary to implement the judgment of SHRC whereby SHRC State Government / District Administration to sanction and pay ex-gratia relief of Rs one lakh in favour of next of kins and in addition extend benefit of SRO 43 of 1994 in favour of the eligible next of kins or in the alternative extend benefit under SRO 199 of 2008 read with Government order No.893-GAD of 2008 dated 04/07/2008. Submitting the case, the petitioner has submitted that her brother Hameed Makroo, got swayed by militancy who in the year 1994 crossed over LoC and after some time returned back. He was arrested by the army officials and serving the jail for six months he got released on 07/01/1994. After his release, he abandoned all his illegal activities and remained strictly confined to his domestic engagements. And when he went to see his maternal aunt at Rakhwochi wherefrom he was kidnapped by some unidentified gunmen who later on killed him and his dead body was found on 13/09/1994 on a nearby road of Gund Khali Naina. |
