Bail denied to accused in kidnapping of minor

Jammu, Oct 9:CJM Reasi Kamlesh Pandita today rejected the bail application of one Ali Akbar S/o Abdul Hamid R/o Village Mankote Tehsil & District Rajouri who was alleged involved in kidnapping of minor.
CJM Reasi Kamlesh Pandita observed that according to the report the accused has been arrested in case under FIR No. 39/2015 for the commission of offence u/s 363 RPC. Police report further reveals that on 25.08.2015, the complainant lodged a written report with the concerned P/S that his daughter who had gone to Shafa Pani Kundradhan and did not return. He enquired from her relatives but did not get any clue. However, he came to know from reliable source that accused has kidnapped his minor daughter and who would kill his daughter and outrage her modesty.
CJM Reasi Kamlesh Pandita after hearing CPO Reasi DP Singh appearing for the state observed that in this case, as per the Section 361 RPC the prosecutrix is minor less than 18 years of age. Court also taken note of the prosecutrix statement recorded under section 164-A Cr.P.C, whereby she has corroborated her kidnapping by the accused. In this case, medical report is awaited. The law for bail is settled that the accused is considered to be innocent unless circumstances warrant in negative and is of conscious that the liberty of the individual is a precious right guaranteed to him in the constitution, but at the same time, such right requires to be curtailed, if the offence is against the public order or public conscience. The offence alleged to have been committed by the accused person is heinous, as has been committed on a minor girl which offence is considered to be not only against the person of the individual but against the public at large. Such offences are being committed day in and day out by the criminals, deserve to be deplored. With these observations Court rejected the bail application.
