4th penalty notice in 6 months, SSRB continues to violate RTI

Jammu, Mar 14: The Senior Law Officer (SLO) of Services Selection Recruitment Board (SSRB) has been issued penalty notice for the 4th time within a period of 6 months by State Information Commission (SIC) as SSRB continues to violate Right to Information Act (RTI). The SLO is also the Public Information Officer (PIO) of SSRB was served with the penalty notice on Feb 25th by Information Commission for denying information to an RTI applicant who had sought details about process of selection of Tehsil Social Welfare Officers. Details available with Early Times reveal that one Dr. Mudasir Bashir, filed an RTI application before PIO, JKSSB on 22-09-2015, seeking details of all the applicants for the post of Tehsil Social Welfare Officer, Item No. 13 of the Advertisement Notice No. 06 of 2013 dated: 10-05-2013. He wanted category wise details of all the applicants for the post of Tehsil Social Welfare Officer, Item No. 14 of the Advertisement Notice No. 06 of 2013 dated: 10-05-2013.
The PIO was under legal obligation to respond to the RTI application as expeditiously as possible but not later than 30 days, which was not done within the stipulated period of time, as prescribed under the Act. Having not received any response from the PIO within the stipulated time period, applicant preferred first appeal before Chairman, JKSSB, seeking necessary direction to the PIO for providing required information. However, the first appeal was not adjudicated. Again being aggrieved of the inaction of the PIO and First Appellate Authority (FAA) JKSSB, appellant approached State Information Commission (SIC) with 2nd appeal on 02-02-2016, praying therein Commission for directing concerned authorities for providing information.
SIC order 25.2.2016 reads: "Commission after hearing PIO and appellant and after going through the records found that PIO has not responded to the request of the appellant at all. Therefore, Mr. Javid Ahmad, SLO-cum-PIO, JKSSB is required to explain why penalty may not be imposed on him under Section 17 of the J&K RTI Act, 2009 for not responding to the RTI application within stipulated time, as prescribed under the Act. His reply, if any must reach the Commission within 15 days of the receipt of this order. Mr. Javid Ahmad, SLO-cum-PIO, JKSSB is directed to respond to the request of the appellant within 07 days of the receipt of this order".
