Production of fake medical certificates by RTI applicant
SIC asks Police to conduct investigation

Jammu, Mar 27: In an interesting case the State Information Commission (SIC) has directed the Police Headquarters (PHQ) to conduct an inquiry against an RTI applicant as he had allegedly produced fake medical certificates before SIC for seeking extra time in filing 2nd appeal.
Details available with Early Times reveal that one Nisar Hussain, a resident of Bhaderwah district Doda filed an RTI application before the SSP-cum-PIO Telecommunications on 11.12.2013 seeking certain information. The PIO Telecommunications transferred the application to PIO, PHQ for assistance on 13.12.2013 as the required information was not available with PIO Telecommunications. The PIO PHQ consequently passed order on 30.12.2013.
Aggrieved with the order of the PIO, the appellant filed first appeal before the First Appellate Authority (FAA) which was decided on 24.3.2014 and partial information was directed to be disclosed because remaining information was held to be as old as more than two decades. The said order was challenged by the RTI applicant before Jammu office of State Information Commission (SIC) .
The State Information Commission (SIC) treated the appeal to be out of time and the appellant was asked to give reasons for condoning the delay within 7 days. The appellant Nisar Hussain stated before SIC that vide his letter dated: 26.8.2014, he gave the reasons for filing the application late and reasons are attributed to health problems. The appellant Nisar Hussain produced a medical certificate from Dr. Shiv Kumar, Orthopaedician, Civil Surgeon, Medical Officer, Bhaderwahwhich was contested to be fake.
PIO has strongly contested the admission of this appeal on the plea that there appears quite contradiction in two certificates issued by the said doctor.
SIC in its order said, "The Commission finds reasonable reasons for misleading the legally constituted body i.e J&K State Information Commission and also the police authorities against whom he is with second appeal before this Commission. Therefore, there being no sufficient reasons for condonation of delay and attempts have been made prima facie to fudge the certificates, therefore, Commission does not condone the delay and the appeal is not admitted for hearing. In view of the serious nature of allegations and prima facie establishment of the charge before the Commission and in view of the fact that attempt was made to mislead the Commission, the Commission finds it appropriate to direct the concerned police authorities through PHQ to conduct investigation about the genuineness of these two medical certificates issued by the doctor which are on their records"
