Kishtwar riots case: HC stays ‘arrest warrants’ against petitioner

Jammu, Nov 12:In a much publicized 2013 Kishtwar Riots case, Justice BS Walia of J&K High Court Stayed the General Warrants of Arrest issued under section 512 CrPC against the petitioner Shabir Ahmed Sirwal booked under FIR no. 145/2013 and challan be not acted upon. Justice BS Walia after hearing counsel for the petitioner in length directed that general warrant issued against petitioner in FIR 145/2013 prior to the order of High Court staying the proceedings in the challan shall not be acted upon till next date of hearing before the Bench and subject to filing of objections by the other side.
This significant order was passed in a petition filed by Shabir Ahmed Sirwal after counselor appearing for the petitioner submitted that Shabir Ahmed Sirwal was falsely booked in FIR no. 145/2013 Police Station Kishtwar, which was registered due to the riots that had happened in Kishtwar where one boy lost his life. On hearing counsel of petitioner in the matter issued notice of motion and Adv Sanjeev Padha appearing for government side accepted the notice of motion. (JNF)
