Srinagar, Dec 16: A Division Bench of Jammu and Kashmir high court today ordered Deputy Commissioner and senior superintendent of police Baramulla to stop all constructional activities in Gulmarg forthwith. DB also directed Deputy Commissioner, SSP Baramulla, and CEO Gulmarg to file compliance report by December 28. "We are prima facie satisfied that all the constructional activities going on at Gulmarg are illegal," the division bench of the court comprising Justice M H Attar and Justice A M Magrey and directed Deputy Commissioner , SSP and all the authorities of GDA to enforce the direction and ensure that no constructional activities is undertaken at Gulmarg till further orders. "If any person violates the court directions and continue with the construction activities, then the aforementioned authority shall forthwith seal such structure," the court said. Hearing a Public Interest Litigation-Mohammad Rafiq Zagar Vs state, the Division Bench also directed that no building material or constructional material shall be transported to Gulmarg till further orders. It also said that all the vehicles which are found transporting construction material to Gulmarg shall be seized and the applications for release of the vehicles shall be listed before PIL Bench and no other court shall entertain such applications," the court said. DB also directed Deputy Commissioner, SSP, Baramulla, and CEO Gulmarg to file compliance report and listed the PIL for further consideration in the week commencing December 28. The directions followed perusal response filed by the CEO Gulmarg and Assistant Executive Engineer, GDA to the status report of SSP Baramulla. "The joint response filed by the CEO, Gulmarg and Assistant Executive Engineer, GDA to the status report of SSP, Baramulla would show that no permission for renovation or repairs in accordance with law has been granted in favour of any applicants," the division bench said, adding, "These authorities more particularly, Assistant Executive Engineer, GDA has granted permissions for transportation of constructional material." The court also directed government to replace Assistant Executive engineer GDA with another person in his place. "We expect the order in this behalf be passed in week's time," the Division Bench added. "The court commissioner shall also left out site for which applications have been made either to the court to the CEO Gulmarg, wherein request have been made for grant of permission for renovation or repairs," the Division Bench added. |
