MSP certificate issued by JU invalid as per UGC guidelines of 2009

Jammu, Dec 16: The recruitment process for nearly 1600 posts of Assistant Professors is likely to face further delay as the candidates, who have secured Ph.D from outside state varsities have decided to go court if Higher Education department would fail to invoke a clause in SRO, making them eligible for Assistant Professor posts.
Even these scholars have also asserted that the Minimum Standards and Procedures (MSP) certificates being issued by Jammu and Kashmir Universities are invalid as per the University Grants Commission guidelines of 2009 for recruitment of Assistant Professors.
Those Ph.D qualified candidates, who have secured degrees from outside state universities have alleged that the UGC regulations came into force in July 2009 according to which the Ph.D of only those candidates was valid, who were awarded Ph.D degree by their respective university, after following all the 11 guidelines as mentioned by UGC notification of 2009.
They further said that the government came up with SRO 124, according to which all the Ph.D scholars have to secure a certificate of Minimum Standards and Procedures (MSP) from their respective Universities.
"Those candidates whose Ph.D degrees are awarded before 2009 and registered before 2009 are not getting MSP certificates from many of the Universities, as the 11 guidelines were not followed by those Universities before 2009 and same is the case with Jammu as well as Kashmir University", they alleged.
"Apart from Kashmir and Jammu university, many other state universities have not been issuing the MSP certificate due to which our future is at stake as JKPSC is not accepting our degree", they said, adding that to ascertain the validity of Ph.D degrees issued after the 2009 guidelines or before, the UGC in July 2015 had constituted Nigvekar Committee, decision of which is still pending.
"If the decision will come in the favour of Ph.D students after recruitment process in state, how we will be compensated", they said.
They further said that they have been appealing the Higher Education department to induct a clause in the SRO 124 as the Haryana government had done, which reads as, "Those candidates, who have been enrolled in Ph.D upto 31st May 2009 shall become eligible for the exemption from the requirement of minimum eligibility condition of NET/SLET for recruitment and appointment for the post of lecturers or equivalent position in Universities/Colleges/Institutions only on acquisition of Ph.D degrees".
A Ph.D scholar of University of Jammu said that they were getting MSP certificate from varsity but the University has been getting a form filled from candidates, in which it was mentioned that 6 guidelines of UGC out of 11 have been fulfilled by the candidate.
An official of University of Jammu, pleading anonymity said that they have been issuing the certificate as per the 6 points formula as per UGC guidelines. "It is as per UGC six points guidelines and the MSP certificate issued by JU was valid", the official said.
Contrary to the claims made by Jammu University official, a senior official of Kashmir University said that the MSP certificate issued as per six guidelines formula of UGC was invalid. "Kashmir University is issuing MSP certificate to only those candidates, who have completed degrees as per 11 guidelines of UGC. It is not the fault of students but fault of University of Jammu", he said.
"The MSP issued by Jammu University is invalid as the six guidelines which was made mandatory as per SP Thayagrajan Committee of UGC was at present, null and void. Consequently the MSP issued as per 6 points criteria is invalid", he asserted, adding at only the JU officials could give correct reply.
