Early Times Report Jammu, Feb 29: Third Additional Sessions Judge, Jammu, Kishore Kumar has rejected the bail application of alleged accused in Akhnoor sex scandal, Harvinder Singh alias Minto. According to the police case, Surinder Kumar on December 2, 2015 filed a written complaint with Akhnoor police station, stating therein that his minor daughter , a 10th class student, had been missing from home since October 12, 2015. He alleged that one Abhi alias Tarsem Lal of Pathankot, who used to come to the school of her daughter and also called her twice on her cell phone, had kidnapped her. On this report, FIR No 221/2015 for offence under section 363 of RPC was registered and investigation of the case was entrusted to ASI Kuldeep Singh, who, during the course of investigation, went to Pathankot along with the complainant and recovered the girl from the possession of Abhi from Nanku Chowk. The accused was arrested along with other persons. The girl was got medically examined from SDH, Akhnoor and her statement was recorded under section 164 A of CrPC. The IO later got identification parade of the accused in the presence of executive magistrate, Akhnoor, and investigation of the case was still going on and there was a panic in the area because of the incident. The judge, after hearing the APP, observed that on perusal of the record it was revealed that the accused was arrested for the commission of offence under sections 363 and 376 of RPC and the investigation had not been completed so far. "The petitioner stands arrested for a very heinous offence and as such does not deserve bail at this stage. I am in agreement with the submissions made by APP. The arguments of the petitioner's counsel has no force in view of the gravity of the offence and also the prevailing lawlessness and the increasing crime of gang rape," the judge said. With these observations, he rejected the bail application of the accused. -JNF |
