Jammu, June 9: High court judge Tashi Rabstan today directed principal secretary (Home), SSP, Rajouri, and SHO of Kalakote police station not to harass a Gujjar boy and his wife who belongs to Bakkerwal tribe. Liaqat Hussain, son of Ghulam Hussain of Khablan in Thanamandi, Rajouri, and his wife Sanam Kouser, daughter of Mohammad Ishaq of Tatapani, Kalakote, have been booked by Kalakote police station under section 363/109 of RPC. After hearing the two sides, Justice Rabstan observed that Liaqat and Sanam had appeared in person and stated that they were major and had been living together as husband and wife with their own consent. He issued notices to the principal secretary (Home), SSP, Rajouri, SHO of Kalakote PS and Mohammad Ishaq whose counsel accepted notice on his behalf. He was allowed four weeks time to file objections, if any, on behalf of the girl's father. Notice was directed to be returnable within four weeks for official respondents. Liaqat's counsel submitted that a false FIR under section 363/109 of RPC had been registered by police at the behest of Mohammad Ishaq who had wrongly alleged that her daughter Sanam Kouser had been kidnapped by Liaqat when the fact remains that they had married according to Muslim Law with their own consent. After heated arguments from both sides, Justice Rabstan directed principal secretary (Home), SSP, Rajouri, and SHO of Kalakote PS not to harass Liaqat and his wife Sanam till next date of hearing before the bench. He, however, said that the respondents might go ahead with their investigation. The SHO was also directed to investigate the matter with respect to the girl's age and file report on the next date of hearing. The court also directed that Liaqat and Sanam would also cooperate with investigation. (JNF) |
