High Court settles seniority dispute of DySP | | | Early Times Report
JAMMU, Mar 10: The High Court of J&K has decided a 20 years old seniority dispute by directing the Home Department and also the Public Service Commission (PSC) to accord status of DySP to Sunil Kumar Gupta from 2001 and to give consequential benefits. The judgement was delivered by Justice Mohammad Yaqoob Mir in writ petition filed by petitioner Sunil Kumar Gupta. He had stated that pursuant to an earlier judgement, he became entitled to be treated as DySP from 2001 whereas the Home Department had issued an order in the year 2006 whereby his seniority as DySP was determined from 2006. The Home Department had referred the matter to the PSC also while relying on a GAD order had opined that the petitioner would get the benefit of seniority from the date of placement as DySP from 2006. While rejecting the contention of the PSC and agreeing with the recommendations of the Home Department, the writ court directed the respondent-state and PSC to accord fresh consideration to the case of the petitioner for settlement of his seniority while construing a GAD order as meaning that the petitioner had to be given effect of seniority from 2001 and not from 2006. Anil Sethi, Advocate appeared for the petitioner whereas state was represented by Gagan Basotra, senior Advocate General and PSC was represented by FA Natnoo. |
