Booked by Delhi Police on criminal charges of sexual harassment

Jammu, Mar 10: In a bizarre development, an officer of the Jammu and Kashmir government who has been booked in a criminal complaint under non- bailable sections by Delhi Police for charges of sexual harassment of a subordinate officer has been posted as Head of Department rather than being reprimanded.
Asif Hamid Khan, former Additional Resident Commissioner at J&K house New Delhi was booked by Delhi police, after the victim, a KAS officer registered a criminal complaint against him in Delhi police. As per confirmed reports, the accused officer was booked under Sections 354, 354-A and 354-B following a written complaint of the accused. As reported by ET in its edition dated January 20, 2015, the victim, a KAS officer had informed the superiors of the department against the harassment being meted out to her by the accused, but no action was taken against him.
However, after ET published the story misadventures of the accused officer and harassment faced by the lady officer, a committee was constituted by the department to inquire into the allegations against the accused. The very constitution of the committee was illegal because it was constituted after the incident, while it was mandatory for the state administration to have Vishakha Committee in place in accordance with the guidelines of the Apex Court.
Sources divulge that the committee was not only illegal, but also biased against the victim from the very outset and despite several requests by the victim to help her in collecting evidence against the accused who was in possession of all documentary evidences by virtue of his position.
"The committee was highly biased in recording the statements and despite audio recording of the statements of the victim; the committee in its report filed today absolved the victim and termed the complaint as false and frivolous" a sources close to the victim divulged. "The accused who enjoyed departmental immunity from the very beginning was transferred from Delhi in order to protect him from possible arrest by Delhi Police, as the investigations in the criminal complaint filed against him were in progress.
"It is astounding that a lady officer of the same department was suspended on October 2, 2014 on a complaint, while this officer was not even attached and on the contrary, he has been posted as Managing Director of a corporation" said a source in the department. "Many officers of the state government have been suspended and attached to the GAD in the past on several pretexts, but Asif Hamid Khan has not only evaded any suspension, he has been rewarded for his misdoing and made HoD" a source in Delhi said adding that the accused may still be arrested by Delhi Police as it has come to the fore that the accused officer was a habitual offender and he was named in similar offence in a Delhi Hotel on an earlier occasion in which a compromise was somehow managed by him.
ET has meanwhile learnt that a senior bureaucrat of the state, who has himself been tainted in an infamous sex sleaze, has been patronizing the accused in this case.
