DB disposes off PIL seeking CBI probe in Kupwara man's death | | | Early Times Report
Srinagar, Mar 10: A Division Bench (DB) of the State High Court comprising Justices Muzaffar Hussain Attar and Ali Mohammad Magrey disposed off a Public Interest Litigation (PIL) seeking investigation by Central Bureau of Investigation (CBI) and Judicial Commission headed by sitting judge into the alleged 'custodial' killing of man last month in Kupwara district. "At the moment, the Sessions Judge Kupwara, being in seisin of the matter, it will not be appropriate to interject the proceedings by this Court," said a Division Bench of the court comprising Justices Muzaffar Hussain Attar and Ali Mohammad Magrey while disposing of a PIL filed by one Khawaab Foundation through advocate Dar Rashid. As per police case on February 10, one Nazir Ahmad Mughal of Gujjarpati, Zirhama, an accused in murder case was in police custody complained of chest pain and was shifted to District Hospital, Kupwara by police for treatment. "He (Mughal) was attended by doctors at District Hospital (DH) Kupwara and after few hours he gave slip to police in the garb of attending the call of nature in the bathroom of the hospital. "Instantly the search was conducted to trace him out and next morning his body was found near the compound wall of district hospital," Police case said. However, the Mughal's family had alleged that he was killed in custody by police and this later sparked series of protests and subsequently district administration ordered magisterial inquiry and arrested three cops. Meanwhile petitioner has submitted a plea to court, seeking a probe by Central Bureau of Investigation (CBI) or Judicial commission, besides seeking directions to the Government to ensure that the guidelines laid down by Supreme Court were implemented within a stipulated time. |
