Jammu, May 7: After the trial of nearly 21 months, Kishtwar session Court today framed charges in murder case of Arvind Raj Baghat against five accused. Three accused were still evading arrest and have been declared absconders by the Court. As per the details available with Early Times, the Principal District and Session Judge Kishtwar Bala Jyoti in a case titled State V/S Adil Aslam and others (Accused) in FIR No. 145 of 2013 registered at Police Station Kishtwar found sufficient material available on record to uphold that accused persons namely Adil Aslam Waza son of Mohammad Aslam Waza , Arif Hussain son of Abdul Rashid, Yasir Hussain son of Abdul Rashid, Ghulam Hussain alias Kala son of Mohammad Anwar Butt and Shabir Ahmed son of Abdul Hamid all resident of Asrar Abad Kishtwar have committed offences U/Ss 302/307/147/148/149/201 RPC as in the investigation conducted by officers of Special Investigation Team. Meanwhile during the arguments, the defense counsel of Adil Aslam Waza rebutted the allegation leveled against his client and argued strenuously that accused persons have been falsely implicated in the aforesaid offences.
"Considered respective submissions (By defense counsel), though this court is not required to hold a roving inquiry in this regard-yet entire material has to be considered for framing of charges, put prime facie there is sufficient material on record to connect the accused persons namely Adil Aslam and Arif Hussain with the commission of offences u/s 302/307/147/148/149/201 RPC as prima facie these offences are made out against them. The contents of charges are read over to aforesaid accused persons. Those did not plead guilty and claims trail." read the court order and further directed the prosecution to lead evidences in this regard since already much delay has been caused. The court also directed the registry of the court to take up the case of weekly basis and Public Prosecutor has also been directed to exhaust his entire calendar of witnesses within two months. The next date of hearing will be held on 15-5-2015.
Among the five accused against those charges were farmed by the court today, only Adil Aslam Waza was in custody since last 20 months while another accused Arif Hussain was arrested by Kishtwar police last month. The other three accused are yet to be arrested and charges were framed against them in their absence. It is pertinent to mention that three people namely Arivind Raj Baghat, Bashir Ahmed Moochi and Lassa Khandey were killed during August 9 and 10th Kishtwar and Padder communal riots, but even after 21 months since the incident took place, not only the murder accused, but other accused who were declared absconders were still roaming free, some of them even attending government offices and were even seen roaming inside J&K civil secretariat premises.
