Court returns Suicide case challan, directs Police for further investigation

Jammu, May 7: In the rarest of rare cases where court took serious note over the investigation, Railway Magistrate Jammu Sandeep Gandotra returned the challan of suicide case with the direction to SSP Jammu for further investigation. While returning the challan, The Magistrate observed that investigation in this challan was unprofessional and suicide note was ignored.
As per challan on 23-02-2015 ASI Mohd Rafiq had recorded the statement of Deepak Kumar at GMC Jammu in which Deepak Kumar had stated that he was married to Simran 9/10 years ago from whom he got divorced. Thereafter, he fell in love with Sonika who was working as a nurse in Super Specialty Hospital Jammu and both of them agreed to marry. He had gone to meet Sonika at Super Specialty Hospital but she raised an alarm due to which he was shocked. He then went to his home and wrote a suicide note which he kept in his room. Later he went to Tawi Bridge for committing suicide and jumped from the bridge, but he escaped with serious injuries. On this statement, FIR No. 36/2015 for offence u/s 309 RPC was registered against accused Deepak Kumar.
After considering the challan, Railway Magistrate Jammu Sandeep Gandotra observed that A perusal of the challan reveals that the investigation has been conducted by the investigating officer in most unprofessional manner and the SHO and SDPO City West have acted merely as rubber stamps and passed the challan without application of mind, ignoring the fact that a precious life has been lost. The IO seized the said suicide note of Deepak Kumar on 25-02-2015. Subsequently, on 01-03-2015 Deepak Kumar succumbed to his injuries and died. The most important piece of evidence with the investigating officer in this case is the "suicide note" of the deceased Deepak Kumar. In the suicide note he has categorically written that. Sonika has cheated him. She had promised to marry him and later on she had refused. That, she was in relationship with him since 02nd January 2014 and she got pregnant by him on more than two occasions. He has also mentioned in the suicide note that he had stayed with Sonika on many occasions in Meridian Hotel and they stayed there for the first time at night on 10th January 2014. For the reason best known to the investigating officer he has totally ignored this note and not made any investigation from the person mentioned in this suicide note.
Court further observed that It is very unfortunate reflection of the working of police in our State.
