Finally, tainted Budgam court's PP sacked | | | Early Times Report
SRINAGAR, May 7: After the recent High Court intervention, the tainted Public Prosecutor (PP) District and Sessions Court Budgam has been sacked by the government. Details available with Early Times reveal that Sheikh Nayeem has been removed from his post as there were serious allegations of corruption against him. The High Court had taken cognizance of a petition moved by a Budgam resident wherein Justice Ali Mohammad Magray had directed the Law Secretary to consider the removal of the PP in view of his tainted track record. The petitioner Javaid Ahmad Sofi had alleged that the PP was trying to give undue benefit to a man who is under detention in Central Jail Srinagar under charges of murdering his (Javaid's) sister. The murder case was pending in Sessions Court Budgam from the last 10 months and Javaid had alleged that the PP was trying to help the accused in lieu of illegal gratification. In this regard he had earlier requested Law Secretary to appoint a Special PP so that there was no undue influence on part of the incumbent PP. Javaid's request was not accepted by the government, forcing him to knock the doors of High Court which gave judgment for considering the removal of PP. Justice Magray had issued an order on 30/4/2015 directing the government to take action against the tainted PP. The order had read: "Secretary to Government Law Department shall consider the removal of (PP) and also explore the possibility of appointment of Special (PP) in the case and report compliance on next date of hearing." The next hearing in the case has been fixed on Friday, May 8 and the Sessions Judge District & Sessions Court Budgam has also been asked to appear before the court. Earlier the residents of Budgam had appealed Law Justice and Parliamentary Affairs Minister Syed Basharat Bukhari to appoint a new PP at Budgam court as the tainted PP "was fleecing the poor people of the district especially the litigants in one way or the other." Nayeem, the sacked PP, is already facing charges of corruption under FIR No: 4/2014 Police Station Vigilance Organization Kashmir. He was caught red handed by Vigilance officials during a trap in February 2014 near Hyderpora, Srinagar. Meanwhile, RTI activists, civil society and local residents of Budgam have hailed the intervention of High Court in this case. They have also lauded Law Minister for his prompt action which paved the way for removal of the tainted PP. "Justice has been done and we hail the timely intervention of higher judiciary and Law Minister in this case," said Dr Mushtaq Khan, an RTI activist who had helped the Vigilance to trap the tainted PP in February 2014 during a special anti-corruption drive in Srinagar. |
