ULB department reinstates official accused of committing criminal breach of trust No mention of embezzled amount in reinstatement order 2/15/2016 11:48:42 PM Jehangir Rashid Early Times Report SRINAGAR, Feb 15: An official of the Urban Local Bodies department accused of embezzlement of more than Rs 50 lakhs has been reinstated despite the fact that the Jammu & Kashmir Police has already established the role of the official in the case of 'cheating'. Nazir Ahmad Sheikh, Senior Assistant, Municipal Committee Ganderbal was suspended from the service following the complaint that he in connivance with a contractor embezzled an amount of Rs. 57 lakhs at the municipal committee. The official was arrested by the police and an FIR (First Information Report) was filed against him at police station Ganderbal. Despite the 'indictment' of Nazir in the embezzlement, Directorate of Urban Local Bodies Kashmir issued the reinstatement order in his favour. The reinstatement order does not mention anything about the amount embezzled by the Senior Assistant in connivance with the contractor. "Pending final outcome of the case, Nazir Ahmad Sheikh, Senior Assistant, Municipal Committee Ganderbal who was placed under suspension by Executive Officer, Municipal Committee, Ganderbal, vide order issued under No. MC/Gbl/2015/2552-55 dated 19-09-2015 and action confirmed by this Directorate vide No. DULB/Estt/593/8200 dated 22.09.2015 is hereby reinstated with immediate effect. The period of suspension of the official shall be decided separately," read the order No. DULB/Esst/593/PS/ 117 of 2016 dated 30-01-2016. Then Station House Officer (SHO), Ganderbal Police Station had submitted to the Deputy Superintendent of Police, Ganderbal that Nazir has committed criminal breach of trust. The SHO has also mentioned about the arrest of the Senior Assistant. "On 02/02/2015 this police station received a written complaint from Executive Officer, Municipal Committee, Ganderbal wherein it is alleged that locker of the Estt section of the Municipal Committee, Ganderbal has been broken and important file titled "Contract for Adda Entry/Terminal Tax for the year 2014-2015" allotted to Mohammad Amin Mir S/o. Ali Mohammad Mir R/o Beehama has been stolen," wrote SHO Ganderbal in his report. The report further read: "On receipt of this complaint, case FIR No. 16/2015 U/S 457, 380 RPC of police station Ganderbal was registered. During investigation, it was proved that the occurrence was not a case of theft of burglary, but actually a case of criminal breach of trust by Senior Assistant Municipal Committee Ganderbal namely Nazir Ahmad Sheikh S/o. Ab Gani R/o Chattergul Kangan in order to cheat the department and to cover up the wrong doings while allotting the said contract to the contractor. On 17/09/2016 the Senior Assistant Municipal Committee Ganderbal was arrested from his office for offence U/S 409, 420, 201 RPC and till date the said employee is in police lockup under police remand." Although, the report of SHO Ganderbal was conclusive about the involvement of Nazir in the matter the Directorate of Urban Local Bodies still chose to reinstate him through the order issued on January 30, 2016.
