Agri Deptt holds DPC in violation of rules | Officers knock Governor's door | | Akshay Azad ET Report Jammu, Mar 18: Gazetted officers of Agriculture Production Department (APD) have alleged that DPC (Departmental Promotion Committee) is being done in violation of rules, with a sole motive to benefit some blue-eyed officers. The Gazetted officers, who have approached Governor NN Vohra, informed Early Times that as per department promotion rules for holding of DPC for Class VI, V, IV, III and II of Agriculture Gazetted Services, the promotion list is finalized by a three member DPC committee of department comprising Special Secretary, SO and Under-secretary but at present all these members were not involved. They also alleged that the full cadre strength of department was 650 employees but list of only 490 employees is finalized. "The Government has itself filed an LPA against an order of High Court besides two stay orders one each by Jammu and Srinagar Court are also in place on promotions", they said, adding that as per rules employees could submit their objections, and same have to be notified by department. As per present case, the employees said, no such rule is followed and department is not notifying the objections. "A certificate is also furnished by department to Jammu and Kashmir Public Service Commission (JKPSC) maintaining that there is no pending case or writ petition but despite pending writ petitions, DPC is being conducted, which is beyond every one’s imagination", they alleged. In the application submitted to Governor NN Vohra, the officers have maintained that Governor’s rule has opened scope for upholding might of law but was overshadowed by APD, which is all set to destroy the basic fabric of law by brushing aside High Court orders dated: 13/10/2015 wherein High Court has ordered that "no further promotion shall be made" but still APD in league with JKPSC were hell bent to demonize the legal authority of High Court to give benefit to some favorites in violation to Recruitment Rules of 1988", they have said. The letter further reads as, "Interpretations of service rule while filling Class-VI posts in present DPC proposal in violation of Govt. order No: 743-GAD of 2007 dated: 28/7/2007, which has not only put every eligible officer in dock but has opened channel for some blue-eyed officers". The letter further reads, "most of the officers appearing in the seniority list of Class-VII issued by the Govt. vide Govt. Order No: 277-Agri of 2015 dated: 11.09.2015 and Govt. Order No: 278-Agri of 2015 dated: 11.09.2015 has caused great loss to the State exchequer by drawing salaries illegally for the period to which they were not entitled to and the period of most of the officers has been treated as dies-non vide Govt. Order No: 67-Agri of 2016 and Order No: 68-Agri of 2016 dated: 26.02.2016 and the proposals submitted by the APD has not ironically been mentioned the period treated as dies-non therefore attempt has been made to give cover for their lost services on account of period treated as dies-non which clearly envisages the presumption and prejudicial approach adopted by APD, which needs to be looked into as it amounts to prima facie for a criminal breach and conspiracy". |
