Why to create ruckus in LA now?

Srinagar, June 5: Javaid Mustafa Mir PDP's MLA and former Revenue Minister created ruckus in assembly on Saturday , over the failure of Government to pay compensation to some farmers who happen to be his neighbours. The said land was acquired few years back by the Government near Lasjan area of Chadoora constituency during widening of Srinagar Jammu national highway. One fails to understand why Javaid is creating such scenes in the assembly when he himself miserably failed to bring in new Land Acquisition Rehabilitation and Resettlement Act (LARR Act) in the state legislature last year when he was J&K's Revenue Minister.
The PDP legislator and former Minister Javaid Mustafa Mir on Saturday asked the Government to provide compensation to people from his constituency whose land had been acquired for highway expansion few years back.
"The Government should ensure presence of its lawyer in the court on the next date of hearing. If the Government lawyer remains absent again then don't blame me," Mir said in the Assembly as Speaker Kavinder Gupta and the Ministers from his party, Peoples Democratic Party and Bhartiya Janta Party, listened to him silently. Informing the House about the case, Mir said in 2008 the Government had acquired around 700 kanal of proprietary land in Lasajan, on Srinagar-Jammu highway for highway expansion. Pertinently Lasjan falls in Chadoora constituency of Budgam but comes under territorial jurisdiction of Srinagar district .
The MLA said the land owners were not paid the compensation and instead the Revenue Department had filed LP in the High Court in 20011-12.
Javaid Mustafa Mir said when the coalition government came to power in the State, the Deputy Commissioner Srinagar was asked to withdraw the LP from the High Court. However, he said the Deputy Commissioner, in violation of norms, shelved the directions of the Revenue Department and instead sought opinion from the Chief Secretary in the case.
"The case is lingering in the court as the Government lawyer has been missing hearing after hearing," said a visibly angry Mir. "My people have lost their land as well as the livelihood. They are suffering now."
"I swear in the name of Allah if the lawyer remains absent on the next date of hearing, then don't blame me for consequences," said Mir
Pertinent to mention that in order to ensure road widening in Srinagar many demolition drives have been undertaken by the authorities in Srinagar city from the last couple of years . At many places this process is going still going on and that includes Lasjan , Pantachowk and many places on Srinagar Jammu highway. PDP lead Government is planning to undertake such demolition drives in other parts of the city for the construction of flyovers and other roads.
"All this is a very positive development indeed, but the amount which the effected families and individuals in Srinagar city are paid is mere peanuts and on the other hand the effected people in other cities of country get very handsome amount as compensation and the reason for that is that all the states in India have implemented New Land Acquisition , Rehabilitation and Resettlement Act (LARR Act) and how unfortunate we are that this law hasn't been enacted in Jammu & Kashmir as NC lead Govt failed to bring in the bill in state legislature during their tenure. When PDP came to power and formed Govt with BJP last year , they also failed to enacted the new land act because Javaid Mustafa Mir who was Revenue Minister never got this bill in state legislature " said Dr Mushtaq Ahmad Khan Social Activist from Srinagar's old city
"Not only Srinagar city even the effected people from Jammu city are being victimized by the Government as the Government is forcibly demolishing shops , residential houses , and other business establishment for construction of roads. In absence of the new Land Acquisition Act in state the people are the direct sufferers as they get half the amount for their acquired property .Chief Minister Mehbooba Mufti and Revenue Minister Basharat Bukhari must provide due and fair compensation to the families whose land and property has been acquired for the purpose of road widening in various parts of Srinagar especially in Pantachowk area and for making that happen Govt must enact New Land Acquisition Act in J&K " said Mohammad Shafi of Panta-Chowk Srinagar.
