SRINAGAR, June 7: Four vital commissions are lying defunct in Jammu and Kashmir despite the PDP-BJP government making tall claims of taking steps for transparency in the state by making independent bodies functional. Failure of the government to re-constitute these important commissions have become a cause of concern for the people who have been visiting their offices to get redressal of their complaints, but to no avail. These commissions need the approval of Chief Minister, leader of the Opposition party and a Cabinet Minister to get the head of any commission appointed. The State Human Rights Commission (SHRC), which has a designated strength of five members, including its chairman, has been rendered defunct since June 28, 2014, when its remaining two members completed their term. The High Court has also served notices to the government several times to make SHRC functional by appointing its chairman and four other members. Sources revealed there are over 2000 cases pending disposal before the commission. Despite that government has failed to appoint the chairman and the members. Similarly, Jammu and Kashmir State Information Commission has also become headless as the first ever Chief Information Commissioner G.R Sofi completed his tenure on February 29, 2016. The post of one State Information Commissioner out of two was already vacant. Dr SK Sharma one of the Information Officers had demitted the office in October last year. As per Section 12 of the J&K Right to Information Act, the general superintendence, direction and management of the State Information Commission vests in the State Chief Information Commissioner and he is to be assisted by the two State Information Commissioners. Chief Information Commissioner, G R Sufi had assumed the office on March 1, 2011 and as per the Jammu and Kashmir Right to Information Act, he is completed his five year tenure on February 29. The Backward Classes Commission is also headless from last two years after the retirement of its chairman Justice Ali Muhammad Mir. As per the guidelines for the appointment of a chairperson for Backward Commission, the state's governor has the powers to appoint such a person in consultation with State Government but nothing is being done to mitigate the sufferings of the people living in backward areas. Jammu and Kashmir State Commission for Backward Classes was established under the J&K state Commission for Backward Classes Act 1997. Sources said "It has failed to serve the purpose for which it was set up. The commission has over the years become a political institution mainly serving the purpose of ruling parties." The State Consumer Disputes Redressal Commission (SCDRC) is also lying defunct and is presently without the president and one of the two members. As per the law, the Commission comprises of a president who should be a former High Court judge, and two other members. The Commission is headless for the past seven months after Justice (retd.) Bashir Ahmad Kirmani was appointed as member of the State Accountability Commission while Shabnum Munshi, a member of the body, completed her term on January 11. |
