Jammu, Dec 20 : Deciding a CIMA appeal of an 84-year-old person, who had lost his son, high court judge Ramalingam Sudhakar today directed National Insurance Company (NIC) to pay him Rs 8,56,000. Disposing of the appeal, he observed that Karnail Singh (84), son of Teja Singh of Chatta Gujran, Jammu, had sought indulgence of this court to dispose of his appeal, seeking compensation for the death of his son Ghar Singh. The appeal was filed in 2012. The court reversed the judgment of Tribunal, declining to grant relief to the claimant. After setting aside the judgment, the court remanded the case for fresh consideration. The Tribunal had granted a meager relief as a result of which the claimant filed an appeal, pleading for compensation against the death of his son in a tractor accident on September 16, 2001 at about 2 pm. He was driving the tractor when the mishap occurred. It appeared that the tractor hit some explosive substance on the land and caught fire. There was a big explosion as a result the tractor also exploded, causing the death of Ghar Singh. The appellant then made a claim for compensation. It is worthwhile to mention here that Justice Sudhakar has decided more than 500 old CIMA appeals.(JNF) |
