Only 78 of 1617 unions have so far file annual returns | Violation of Trade Unions Act | | Arun Singh

Jammu, Mar 12: Despite repeated notices to trade unions and associations functioning across the state by the office of Registrar Trader Union to submit their annual returns, only 78 trade unions/ associations out of 1617 registered with the office have submitted their annual returns for the years of 2013 during 2014 till date in violation of the Trade Unions Act 1926. Sources told Early Times that under section 28 of the Trade Unions Act 1926 all the unions/ associations registered with the office are required to submit their annual returns on prescribed form "D" to the Registrar of Trade Union (Labour Commissioner, J&K) for the period ending 31st December by 31st July of succeeding year. "Inspite of having sent a number of notices to the hundreds of trade unions/associations to submit their annual returns to keep them in legal framework for their smooth functioning, only 78 trade unions have filed their returns so far," they said, adding that 1496 Trade Unions had failed to file returns which warrants for the cancellation of registration certificates granted under Trade Unions Act, 1926. Sources divulged that the Registrar of Trade Unions had realized a revenue of Rs 22,500 during 2014 from the trade unions which had filed their returns. "It is mandatory to file annual returns for every Trade Union/Association with the office of Registrar Trade Union," sources said and added that it was illegal not to file the annual returns. They said that department had a served number of notices to initiate penal action against the defaulting trade unions to furnish/file their returns in the office of the Registrar of Trade Unions (Labour Commissioner) failing which action under law shall be initiated against them which includes cancellation of registration granted to the defaulting trade unions. They said that the returns should be sent annually to the Registrar on or before such date as may be prescribed, a general statement, audited in the prescribed manner, of all receipts and expenditure of every registered Trade Union during the year ending. When contacted, Labour Commissioner Vipra Bhal said, "We have served a number of notices to the defaulting Trade Unions to file their pending returns at the earliest to avoid their cancellation and legal action will taken against those failing to comply with the order and the functioning of such Trade union will be deemed illegal." Pertinently, Trade Unions are formed primarily for the purpose of regulating relations between workmen and employers or between workmen and workmen, or between employers and employers, or for imposing restrictive conditions on the conduct of any trade or business, and includes any federation of two or more Trade Unions. |
