Appointment of Class IV employees in CAPD Deptt Baramulla | SIC issues penalty notice against AD | | Early Times Report
Baramulla July 12: As the Assistant Director Consumer Affairs & Public Distribution(CAPD) Department Baramulla made unnecessary delay in providing information under State RTI Act related to the appointments made for class IV employees in CAPD Baramulla, the State Information Commission (SIC) has issued penalty show cause notice against the said officer under section 17 of J&K RTI Act 2009. Details available with Early Times reveal that one Mohammad Arif Malik a resident of Chanderkoot Baramulla made a request on 1.10.2014 under J&K RTI Act, 2009 before Assistant Director CAPD Baramulla who is also the designated PIO under State RTI Act. The applicant sought some information pertaining to appointment of class IV employees in department of CAPD Baramulla. As the information was not provided the applicant Mohammad Arif Malik filed First Appeal on 03.04.2015 before the Director CAPD Kashmir who directed PIO to explain reasons for not furnishing requisite information within stipulated and directed PIO to provide requisite information to the RTI applicant within three days positively. The State Information Commission (SIC) received Second Appeal on 27.05.2015 against PIO for her failure to provide information. The appellant has contested information provided vis-à-vis information sought. In her counter reply submitted before SIC to the Appeal, PIO/Assistant Director CAPD Baramulla vide reply dated 15.06.2015 submitted that as per records available in the office, the applicant has already been provided all the information sought by him vide letter dated 27.04.2015, but the applicant is intentionally misleading the authorities by alleging that he was provided wrong and incomplete information to malign the image of the department . SIC in its order ruled, "PIO is directed to provide final merit list indicating marks for academic and interview to the information seeker within 1 week under intimation to the Commission. The Commission has also noted that appellant has filed First Appeal after expiry of mandatory period which has been disposed of by FAA by taking administrative action. However, keeping in view the spirit of RTI Act, the Commission has admitted and adjudicated upon the Second Appeal. Prima facie, there is delay in responding to the RTI application beyond prescribed period. Therefore appellant is entitled to information free of cost. Accordingly, PIO is directed to reimburse amount of Rs. 50/- deposited by the appellant as copying charges. Dr. Sheeba Inayat, PIO/Assistant Director CAPD Baramulla is also directed to explain as to why penalty proceedings shall not be initiated against her for delay in disposing of the RTI application. Her explanation, if any, should reach the Commission within two weeks from issue of this order." |
