HC directs AG to file status of departmental action against ex-CEO, others | Alleged hushing up of RDA scam | | Early Times Report
Jammu, Mar 2: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today directed the advocate general and the senior AAG, appearing for GAD, to file the latest status of regular departmental action recommended by state vigilance organisation (SVO) against accused in Rajouri Development Authority (RDA) scam. SVO, vide its verification No VO-Veri-PR-13/2009-9835-36 of July 3, 2015 and verification vide No VO-Veri-PR-31/2009-8497-98 of June 10, 2015 had recommended regular departmental action against Mohammad Javed Khan, then chief executive officer (CEO), Khushal Chand, then executive engineer, Devi Dass Heer, then executive engineer and Gurcharan Singh, then junior engineer in RDA. After hearing the counsels for petitioner, GAD, SVO and then RDA CEO, the bench allowed time to the AAG and the senior advocate to file response to the fresh application filed by petitioner seeking setting aside of communication No VO-Veri-PR-13/2009-9835-36 of July 3, 2015 whereby, according to him, SVO had converted a case of criminal misconduct into regular departmental action when loss to the state exchequer was established by VOJ to the tune of Rs 1,93,915. The ex-CEO's counsel submitted that the petitioner had filed a number of petitions targeting people who were occupying responsible positions in the present setup. He said there should be a restraint on reporting of this matter as the PIL had not been decided as yet but its continuous reporting was affecting the service career of his client. At this stage, the petitioner's counsel strongly resisted the arguments of ex-CEO's counsel and submitted that he was a public spirited person fighting graft. He said the petitioner received inputs through RTIs and had exposed various scams involving higher officials. With regard to reporting of the matter in the media, he said people of the state had a right to know and this right had been recognized as a fundamental right. SVO's petitioner submitted he should be given some time to respond to the fresh application filed by petitioner, seeking setting aside of communication No VO-Veri-PR-13/2009-9835-36 of July 3, 2015. After hearing both the sides, the bench directed the advocate general and the senior AAG to file the latest status of the regular departmental action recommended by SVO in the two verifications conducted by it in RDA scam. The bench also allowed time to the AAG and the senior advocate to file response to the petitioner's fresh application. (JNF) |
