Reveal info about works executed under CDF: SIC to XEn Kargil

Srinagar, June 9: The State Information Commission (SIC) has directed the Executive Engineer, Rural Engineering Wing (REW) Kargil to provide information under RTI Act to a person about the works executed in Sankoo area of Kargil under the MLC's constituency development fund (CDF).
The information was not earlier provided to the information seeker which prompted him to file an appeal before the SIC at Srinagar.
Details available with Early Times reveals that one Sadiq Ali, son of Mohammad Baqir, a resident of village Tambis, Sankoo (Kargil) had filed an RTI application on 14.01.2015, seeking information about amount spent under MLC fund in Nagma Kousar area of Sankoo block from 2012 to 2014. The RTI applicant had also sought details of estimate copies and name of the person who was allotted this work.
As the information was not provided, the RTI applicant filed First Appeal before First Appellate Authority (FAA), that is, Project Director DRDA Kargil dated on 18.02.2015 on the ground that no response has been received by him, although Nodal Officer had forwarded the RTI application to ACD (PIO) Kargil on 15.01.2015.
The SIC received Second Appeal on 21.04.2015 on the grounds that the applicant moved an application to under J&K RTI Act 2009 dated 14.01.2015 before ACD Kargil, who failed to provide the required information to the appellant within prescribed time.
The appellant further submitted before SIC that he filed First Appeal before Project Director DRDA Kargil (FAA) under section 16 of the Act dated 18.02.2015 and the FAA who too denied information. The appellant prayed before the Commission that detailed information sought be provided to him.
In reply to the notice of the Commission on 29.04.2015, Mohammad Sadiq, Project Officer Wage Employment (ACD) Kargil filed para wise reply to the Second Appeal stating that RTI application of the appellant was transferred by ADC Kargil vide his letter No. RTI/2041/83 dated 15.01.2015 to ACD Kargil.
Accordingly his office vide letter No. POW/ACD-K/RTIA/5234-36 dated 20.01.2015 requested Executive Engineer, REW Kargil to furnish the information to the applicant within the stipulated period as all the works under CDF MLC (2012-14) have been executed by Executive Engineer REW, Kargil and his office has no record/files in this regard.
The appellant approached FAA on 23.02.2015 and the then ACD directed Executive Engineer for filing reply. Executive Engineer reported to SIC that the information was already submitted to the applicant vide his office letter No. Xen-REW-K/RTIA inf/14/1725-27 dated 10.02.2015.
SIC's order dated 15.5.2015
"In view of the above facts, it is held that Executive Engineer REW Kargil is holding the information sought by the appellant and therefore, he is deemed PIO in this case. Accordingly, Xen REW Kargil is directed to provide one set of information dated 10.02.2015 alongwith copies of allotment/estimates of works listed in the statement enclosed with his letter dated 10.02.2015 to the appellant Sadiq Ali within two weeks of receipt of this order through prescribed mode of service and a compliance report be submitted to the Commission."
